Scott Smith of Mount Vernon and Andrew Nappi of Eastchester have each been charged with first-degree assault and second-degree assault, according to The Sun, which reported that the victim, Joseph Bauer, remained in critical condition Monday in a Maryland hospital.

According to The Sun, the victim’s family says he is not responsive and that they’re uncertain about whether he’s suffered brain damage.

Smith, 30, is a Mount Vernon firefighter, according to The Sun, which reported that he was released on $50,000 bond while Nappy was released after posting $25,000 bond.

Smith is just the latest civil servant in Westchester to face professional consequences for his actions outside of the station.

Earlier this year, Mount Vernon Fire Lt. Omar Lanier was suspended from his position after allegedly making inflammatory comments on Instagram in support of police killings.

Mount Vernon Firefighter Joseph Porticelli, 44, was placed on paid leave this year after being arrested and charged with threatening and stalking his ex-wife.

Also accused of improper action outside the office in 2016 is Mount Vernon Police Officer Omar Kitson, who is alleged to have fired his sidearm during an off-duty drunken rampage.

Kitson joins former city firefighter Henry-George Thomas – brother of Mayor Richard Thomas – who pleaded guilty in January to illegally selling a gun just blocks from his firehouse.
