About 12:55 a.m., Nov. 22, a state trooper stopped Daryl McKee, 37, for allegedly failing to stay within his driving lane.
Upon further investigation, law enforcement officials determined McKee was intoxicated.
A breath test revealed a blood alcohol content of 0.17 percent, which is just over twice the legal limit of 0.08, police said.
McKee also has a previous DWI conviction, according to police, which is why the charge is a felony.
His next scheduled legal appearance will be Dec. 3 in the Village of Croton Court.
