Police said an officer was dispatched to the intersection of Route 202 and Springhurst Street on the report of a vehicle on the side of the road and a subject sitting next to it.
Upon arrival and with further investigation, the officer found out that the vehicle had gone off the roadway and struck a snow embankment.
Fierro was placed under arrest and transported to the Yorktown police department for processing. Fierro was found to have a blood alcohol level content of .08 percent or greater, a misdemeanor.
He was also charged with disregard of a traffic control device, a traffic infraction; failure to use a designated lane, a traffic infraction; and unlicensed operator.
Following processing, Fierro posted $300 bail, was issued an appearance ticket and released to a friend. He is scheduled to appear in Yorktown Justice Court on April 7, at 6 p.m.
