State Police Arrest Several Dutchess Drivers For DWI Over Weekend

In the stretch of time between Friday, Jan. 6 and Sunday, Jan. 8, police made nearly 20 arrests and issued dozens of tickets to various motorists for driving while intoxicated and drug offenses over the weekend.

According to police, on Friday, troopers from Cortlandt arrested Croton-on-Hudson resident James Walker, 47, when he was stopped for a traffic violation on Albany Post Road in Peekskill. During the investigation, police collected a breath sample that yielded a blood alcohol content nearly twice the legal limit. Walker was charged with a misdemeanor charge of driving while intoxicated and issued traffic tickets directing him to appear back in City of Peekskill Court on Monday, Jan. 16.

Later that day, police from Stormville arrested 20-year-old Fishkill resident Tyler Martin on a charge of driving while ability impaired by drugs. Police stopped Martin for driving erratically on the Taconic State Parkway and during the subsequent investigation, troopers determined he was under the influence of unidentified drugs. He is due back in East Fishkill Court on Wednesday, Jan. 18.

The following day, Anthony Testerman, of Wappingers Falls was charged with a felony count of driving while intoxicated for his second offense. Troopers from Poughkeepsie stopped the 26-year-old on Route 376 for operating his vehicle without a front plate. When police conducted their investigation, they found that Testerman was intoxicated, with a blood alcohol content of .10 percent. His charge was upgraded when it was determined that Testerman had a previous DWI conviction from 2015. He is due to appear in the Town of Wappinger Court next week.

Also on Saturday, 33-year-old Tomas Smid of Holmes had been arrested on a felony count of aggravated driving while intoxicated after being stopped in Southeast, police said.

According to police, Smid was driving on Route 22 when troopers from the Brewster barracks stopped him for not having his vehicle’s headlights illuminated. During the subsequent investigation, it was determined that Smid was intoxicated at the time of the stop.

A breath sample provided by Smid to police during the traffic stop revealed he had a blood alcohol content of .22 percent, nearly triple the legal limit. During the investigation, it was revealed that Smid had a previous DWI conviction in 2008, prompting arresting troopers to upgrade the charges.

Smid was issued traffic tickets and is due back in the Town of Southeast Court on Thursday, Jan. 26.

On Sunday, troopers from Wappinger arrested Fishkill native John Barberan, 51, and charged him with felony charge of driving while intoxicated, his second such offense since 2009. Troopers stopped Barberan on Main Street in Fishkill, and police determined he was operating his vehicle under the influence of alcohol. He was arrested and arraigned in the Village of Wappinger Falls Court.

Barberan remains remanded to the Dutchess County Jail in lieu of $1,000 cash bail or $3,000 bond. A complete list of the 16 offenders can be found online.

“Intoxicated and impaired drivers put others at risk,” New York State Police noted in a statement. “It is a priority of the State Police to keep impaired drivers off of our roadways so law-abiding citizens can safely travel throughout our four county patrol area.”
