Members of the Scarsdale Police Department were dispatched to the Village Hall parking lot on Wednesday, Aug. 16 following reports from a court officer that two individuals were taking pictures of themselves with their pants down before leaving in a black pickup truck.

The responding officers flagged the vehicle and while conducting the subsequent traffic stop, police reported that there was a strong smell of marijuana coming from the inside of the vehicle, which was being driven by 19-year-old Fishkill resident Orville Berry, Jr.

During the stop, Berry willfully showed police proof that he and his passenger were only taking “selfies” in the parking lot, none of which were indecent. However, a DMV check by police showed that Berry had his driving privileges suspended earlier this month for failing to answer a summons in the Bronx. He also had an active warrant out for his arrest in Queens. A vehicle check revealed that the registration was suspended in May for no insurance.

According to police, when asked if he had marijuana in his possession, Berry told the officers that he had two joints in the car that he had rolled himself.

Berry was arrested and charged with misdemeanor counts of operating a motor vehicle with a suspended registration and aggravated unlicensed operation of a motor vehicle. He was also cited for unlawful possession of marijuana, a violation. He was arraigned and released on $100 bail. He is due back in Scarsdale Village Court later this week.
