A 28-year-old man is facing a drug charge after being busted by police investigating him for allegedly throwing a rock at a car and intentionally damaging it at a busy gas station in Northern Westchester.

Officers from the Yorktown Police Department were dispatched to the Gulf gas station on Commerce Street at approximately 4 p.m. on Wednesday, Nov. 28, where there was a report of an altercation in progress.

Police said that the investigation into the altercation determined that Yorktown resident Sidney Russ allegedly intentionally damaged a vehicle at the station by throwing a rock at it, causing $750 in damage. Further investigation found that Russ was in possession of marijuana and he was arrested.

Russ was charged with criminal mischief, a felony, and unlawful possession of marijuana at Yorktown Police Headquarters. An Order of Protection was also issued protecting Russ’ victims. Following his arraignment, Russ was remanded to the Westchester County Jail in lieu of $1,500 cash bail. He is scheduled to appear in Yorktown Justice Court on Tuesday, Dec. 4 to respond to the charges.
