Yorktown, Peekskill Independent Primaries Caught Up In Court

YORKTOWN, N.Y.-- Several local races in Yorktown and Peekskill in the Independence Primary Election won't be decided until courts have evaluated every vote, according to The Examiner News.

The Westchester County Legislator race for District 1 between incumbent Republican John Testa and Democrat Duane Jackson was too close to call for the Independence line. Both sides filed paperwork with the Board of Elections to have the machines and write-in votes impounded and recounted. Both cases will be heard on Friday, Sept. 27, according to the Examiner News.

While Jackson was the lone candidate on the Independence ballot, Testa's camp felt he tallied enough write in votes to secure the nomination, The Examiner News reported.

Another court battle is holding up the Yorktown Supervisor race for the Independence line. Democratic nominee Nick Bianco received 119 votes on the Independence line while Republican Supervisor Michael Grace is awaiting the count of write-in votes. The courts will have their decision in that race on Nov. 5, according to The Examiner News.

Peekskill Republicans are also contending that mayoral candidate Frank Catalina secured enough write-in votes to hold the Independence line against Democratic incumbent Mary Foster, who received 35 votes in the primary, The Examiner News reported.
